Probate - division of assets

My inlaw passed intestate. There was a prenup showing what was seperate property. What claim does the survivor have on the seperate property assets and are survivors assets considered community property if called seperate property in prenup?

You should talk to an attorney on this one. There may be homestead issues, reimbursement issues and properties of mixed character. My sympathy on your loss.
