Legal Question in Wills and Trusts in Texas

probate estate

My father passed 8/05 the application and letters were filed in 09/05. The executor appointed has withdrawn. What new paperwork should I be expected to file for the new appt. of executrix. I was second in line. Since the original info. was filed. How do I keep fees to a min. And can I get the proper forms at a Law Library?

it should not be that expensive (depending on the county) to file a motion and order concerning the new executor. I am not aware of any "forms" for this.

Have the first executor's written withdrawal filed with the Court. Since you are named as second in the will, all you need to do is execute the executor's oath before the probate clerk.
