Legal Question in Wills and Trusts in Texas
Probate law
My grandmother died in 1986 and we didn't probate her will. Is it too late? I found some stock certificates recently and according to her will they were to go to me and my sister. She took my mother out of her will so since her will was not probated do me and my sister have any rights to the stock? I was also told about an affidavit of heirship which would name my mother. If the affidavit has to be done can it be done without an attorney?

Re: Probate law
If you have the will, it's not too late to have it probated as a muniment of title. You may have to explain to the judge why it wasn't probated earlier.
You can do an affidavit of heirship without a lawyer. It's not advisable, but you can do it.
