Probate

Do I have to probate my spouse's will if the estate consists only of life insurance and retirement funds? All benefits are payable to myself and there are no challenges to the estate.

If that's all there is, then probate isn't required. However, if you've overlooked ownership of a house, etc., then probate is required in order to have clear title to community assets.
