Legal Question in Wills and Trusts in Texas
probate a will
My father recently passed and I have been designed as the executor of his will. No property (vehicle or house) is involved in the estate. Total amount that remains after expenses is less than $2000.00. I live in Virginia and he died in San Antonio Tx. Please advise if the will should be probated in a court. If not, how should I handle a public announcement for any past debts (ie newspaper in San Antonio Tx? I see no reason to spend approx $1500.00 for legal services from the remaining amount.

Re: probate a will
I'm sorry to learn of your father's death. Are there other heirs besides yourself? Is there an alternate executor? is anyone who is interested in the will living in Texas? If you don't want to probate the will, you can decline, and notify the alternate executor. Also, there is a procedure in place to notify creditors after probate has commenced. In many cases, most small unsecured debts can be legally barred if the will is probated.
