Probate

Is it necessary to probate a will in Texas? My Dad died in Dec 2006 and had a will. My Mom is still alive but doesn't want to go through the process of probating the will if it's not necessary. My Mom is still in good health and there are only my brother and myself as siblings.

In order to pass your father's property, particularly real estate, the will must be probated. There are alternatives to full blown probate, but your father's property does not pass without it.
