Legal Question in Wills and Trusts in Texas

Probate/Estate

The father died without a will. He had no wife at the time of his passing and had 8 children (heirs). Had an older vehicle and siblings can't agree on who gets the car. One sibling will not sign affidavit of heirship as he wants the car...period. What can we do to bypass this sibling or what can be done legally to sell the car to someone and share the proceeds equally?

Re: Probate/Estate

You could an application to determine heirship in the probate court and obtain an order of sale from the court. Probably cost more than the car is worth. Probate court allows for recovery of attorneys fees for the one who caused the legal action. See an attorney or junk the car. You can't sell it because you can't change the title.
