Probateing a will

Can the person writing the will preside over the case latter on whenhe becomes a judge?

He can unless he would be biased, in which case, someone would have to ask him to step aside unless he would do so voluntarily for some reason.

Not unless there's a miracle. A will has no effect until the maker dies. If he's a sitting judge, he can't rule on his own will. He's dead!
