probating a will

Do we have to go through an attorney to probate a will? My mother has assets less than $21,000. Her will leaves her house to her five children. We are all in agreement as to how to divide the proceeds from the sale of the house. Is there a less expensive way to get the clear title of the house?

Less expensive than getting an attorney who knows how to get the title out your mom's name so the assets can be divided among the children the way she wanted as opposed to not knowing what to do or how to do it or how to get the job done. I suppose if you don't want to hire an attorney, you can do the job yourself. Just burn a little mid-night oil. If you're pretty good at studying, it might take you a month or so (maybe less) to figure out what the lawyer already knows how to do. Good Luck.

If there is no debt, then you can do a summary proceeding which will be inexpensive. I recommend against your doing this without a lawyer. The amount you "save" may be far less if you find out you messed up the title to a parcel of property.
