My father died in July of 2004. I was living with him with my children in order to help take care of him and the bills from 2000 until his death. My brother lives next door on the same property. He is having personal problems and is now wanting his half of my dad's house which I still live in. My father left no will but told my brother and I that the house was both of ours. It is a 1987 moblie home and I have paid all taxes and insurance since my father's death. How do we split the house value and how do we find out the amount? The property is not in question.

You should have an affidavit of heirship prepared so the house and property gets transferred into both your names. Since you legally have a half interest in his property (assuming the property itself was in your father's name) he might be willing to swap his claim for your claim. You are also entitled to one half of the taxes and insurance that you paid to protect his half interest.
