Legal Question in Wills and Trusts in Texas

my father in law just passed away. his common law wife will not give us a copy of the will, also we found out when he bought his home she signed her name as gwen--name removed-- it is not--name removed--it is something else. what recourse do we have to take the home and get a copy of his will?

Assuming that this is in Texas, simply file an application for probate and get a court order that she produce the will.
