Legal Question in Wills and Trusts in Texas

Property Rights

I have a house, clear deed since 2000 in my name. I recently remarried, last month. What right does my spouse have to my house if I die?

Re: Property Rights

You can grant rights by will. If no will, your spouse's portion depends upon whether you have any children, if your parents survive, or if you have any siblings. Your spouse will receive at least an undivided one half, unless you have any children (or grandchildren if you child doesn't survive you). In that case, your children get the house, less the life estate your spouse will inherit.

Make the distribution you want with a will, rather than relying on the courts.
