Legal Question in Wills and Trusts in Texas

Real Estate

I have a house under contract with the former POA of the estate. The owner passed away after the contract was signed and now the POA is executer of the estate. However, the will is probate and I wanted to know the best course of action in this case.

Re: Real Estate

If the will names the former POA as the executor of the estate, you can deal with the executor. The contract passes to the estate, but it may be mutually terminated if it's in everybody's best interest to do so.

The best course of action will be determined by economic, not legal, factors.
