Legal Question in Wills and Trusts in Texas

Real Estate/probate

My father's estate is a heir to his father's estate which has not been officially settled but has been around for 25 years. All of the estate's assets have been distributed very litte records, except 3/4 a section of land. All the heir's understood this land was to be equally divided. Is there any thing I can do to force the division of the land and the settlement of the estate?

Re: Real Estate/probate

Path of least resistance, get all heirs (as stated in the probate records) to sign off on an agreement of how to split up the land. Should they fail to agree, you could, in theory make an appearance in that action, and request a partition of the remaining land. If there is no way for you to make an appearance, but you have a claim of right to the land, then you can file an action for partition in the appropriate county.

Yes. Be prepared to spend money to make a motion to the court for an accounting and closing of the estate. good Luck.
