Legal Question in Wills and Trusts in Texas

I recently received a one-time death benefit check payable to my mother's estate in care of myself. She died fourteen years ago and her will was not probated. The insurance policy did not designate a beneficiary. However, her will, designated myself and sister as beneficiaries of any assets at time of death. The insurance company will not make check payable to us. The bank says an estate account must be opened to deposit or cash check. What recourse do we have or how do we resolve?

How many children did your mother have, total? Was she married before she died? If so, how did that marriage end (with her death, his death or in a divorce)?
