Legal Question in Wills and Trusts in Texas

Refusal to Cooperate with Will

My mom's will requires that we sell her house and contents within one year of her death. My two brothers live in the house, one is cooperating but the other refuses to move out of the house. What options do we have to get him out of the house so that we can move forward with selling it?

The executor can evict him. Follow the procedures given to you at your local justice of the peace office - must be at the office that has the jurisdiction over the property.

Has the will been probated? If so, then the executor should file for an eviction.
