Legal Question in Wills and Trusts in Texas
Renounced Gift: Intestate Succession or Residuary Clause?
I am trying to research a question that came up in our Wills class that our teacher didn't know the answer to. Here goes: If a gift in a will which has a residuary clause, is renounced does it pass through the residuary clause or through intestate succession? Our book says a renounced gift passes through intestate succession, but does not specify what happens if the will contains a residuary clause. Please help! --name removed--

Hit the annotated statutes, Tiger. If you get through and start practicing law, no one else is going to do your research for you.
