Legal Question in Wills and Trusts in Texas

Renouncing an Inheritance

My last elderly aunt passed away and

I understand I am included as a

beneficiary in her will. What is

required for me to renounce any

inheritance? I don't need it and I

would like anything coming to me to

go directly to others that were near

her over the past years. To what

extent may I specify to whom my

portion goes?

Re: Renouncing an Inheritance

You can "disclaim" by filing a disclaimer with the probate court. When you do that you share goes back in the pot to be distributed according to the terms of the will. You could accept your share and "gift" your share to a designee. Depending upon the value, it might be subject to federal gift tax. You should consult with a lawyer for more complete information on making this decision.
