Return of Automobile
Prior to my mothers death her car was loaned to my sisters brother in law. My mother has died. I am the executor of the will. I have asked that the car be returned. The individual with the car says he wishes to purchase the car but has not funded the purchase and will not return the car. I have asked twice over the last 3 weeks that the car be returned with the response that the individual wants to purchase the car at a reduced rate. Am I within my rights to declare the car stolen if he will not return the car?

No, the car isn't stolen. You may sue him for conversion for the value of the car on the date you demanded the return. Sue on behalf of the estate.
