What are my rights as a blood child

My father was in a car accident and passed away. He did not have a will. He does have life insurance through his work and my step mom is the benficiary. I was told since he does not have a will I'm entitled to half and my step brother is not. Is this true? I'm not wanting to take her for half I just want to know my rights. At this time I'm paying all the bills until the insurance money comes in.

You're are entitled, as a matter of law, to his half of the community property when his estate is entered into probate. The insurance passes to your stepmother by contract, and is not part of his estate.

If your father was not at fault in the accident, then you are entitled to a share of the insurance proceeds that are available from the other driver. You can speak with our office about it for free if you like.
