Rights of heirs

My step father hired a lawyer asking me and my sisters to waive our rights to the home and property that my mother and he bought in Feb'92. He is planning on selling the property and move, what rights do we as heirs to her estate have. My mother passed away without a will. Any help would be most appreciated.

You and your sisters have an undivided half interest in the home; your mother's half interest, assuming the home is in Texas. Your stepfather wants you to waive your interest in your mother's estate; i.e. half the value of the home.

What you choose to do next is strictly up to you and your sisters.

Generally speaking, your step dad gets half of the property and all of the step children get the other half. Your step dad is entitle to a life estate in the house.
