What are my rights

I am a Nurse employed as a reimbursement consultant in tx, long story short, I was in a hostile enviornment, repeated verbal abuse, work overload d/t staff shortage, working at times 12-16 hrs daily. Usual & customary practice with our company is to follow chain of command for grieviences, I did in writing, email & phone and face to face with direct supervisor. Nothing was done to resolve the problem, I continued working until my body mind and spirit broke. Admitted myself to hospital for 30days on10-10-07 am on FMLA, I am told by my physcian at this time not capable of returning to work. My FMLA is up on 1-2-07. I notified HR department, and requested Medical Leave, the response : they will accept voluntary resignation as I am in a Key position critical to revenue, I sent them a response : I continue to request Medical Leave and will gladly accept a lower position upon my return.

I seen nothing in your story that amounts to illegal conduct - a bad place to work, yes - but not illegal. Hostile environment applies to on the job harassment for age, race, sex, religion, national origin or disability. Does not apply to bad working conditions. Try to find a new job.
