Legal Question in Wills and Trusts in Texas

share and share a like

My inlaws have property that they have willed to their three sons. The will states that the three sons are to ''share and share a like'' the 279 acres. After my inlaws pass away, can the three sons divide the property equally so that each son has their own track of land seperate from the others?

Re: share and share a like

The language means they each have an undivided 1/3 interest in the property. It may be partitioned in kind, if one wants it partitioned. That means getting an appraiser and a surveyor to divide up the property so that each portion has equal value. Then the sons will have to choose to see who owns which portion.
