Legal Question in Wills and Trusts in Texas

Sibling taking advantage of Trust

My brother-in-law appointed himself as power of attorney over his mother. Now we think he is using money that is in her trust for everything he needs. There is also a bank account under their deceased father, that we think he is taking money out of. This cannot be confirmed because my husband can't get any bank statements. Neither he or his wife is working. They are also staying in their house, since it's paid for. While his mom is in a nursing home. His brother may be going to prison for aggreviated assault with a deadly weapon. He has also been in prison before. My husband and I have held employment for 5 years, and we are both still working. Is anything that we can do? What should we do?

Re: Sibling taking advantage of Trust

You can sue him for an accounting. The facts you recite would probably support your petition and a request for bank records. Good Luck
