Legal Question in Wills and Trusts in Texas

Small Estate Need to be Probated?

My sister died leaving a small amount of money and a Certificate of Deposit for $1720. My nephew is the executor.

In view of the small estate of around $10,000 including the CD, what requirements are necessary to settle her estate.

Thanks.

Re: Small Estate Need to be Probated?

You didn't say whether there were any debts of the estate that need to be settled. If there are, then you may need administration, and you may be able to handle it as a small estate.

If there are no debts, you're probably better off handling it as a muniment of title.

I'm assuming, from your identifying an executor, that there's a valid will involved.
