Legal Question in Wills and Trusts in Texas

My son passed away in June of 08 and he had no will but my ex husband had a will drawn up and had my son sign in while his toxin's was so high his brain was not functioning. We went to Mediation and agreed on a lot of things.

But there is one thing that sticks out in my head. My son had a Insurance policy with the Pasadena Fire Department and my son never took the time to change the beneficary from his old girlfriend to someone else of his choosing so my ex husband and the Fire Chief allowed him to change the beneficary to himself which is my exhusband. He would not give up the money he received from that so is there anyway that I can file suit against the Fire Department for allowing this illegal form to be signed. The Power of Attorney was signed the same day as the will.

It sounds like there is a bit more to this story. You may have an argument that your son lacked capacity or that your husband exercised undue influence. This is not an easy fight. Feel free to call me if you want to discuss this in detail.
