Step-father not cooperating

Mother died almost 5 years ago with no original will. Step father is living in house with all family things and no intention of giving them up. Hired a lawyer to file copy of will, but he filed it too late (I'm trying to handle that). In the meantime my grandmother died with a life insurance policy left to my mother. Can I use the policy as leverage to get my mothers things from the house? He has since remarried and I am afraid everything will go to her. If not what can I do now?

If there is no will, or the time for filing has passed, you can still institute an action to determine heirship. You may have an interest in the property and in the insurance proceeds. You should probably do this sooner rather than later.
