Legal Question in Wills and Trusts in Texas

This is a strange situation. There isn't any property but there is money. My mother in law passed away a couple of months ago, suddenly and unexpectedly. Prior to her passing she recieved a couple of settlement checks from a lawsuit she won. When she received the first check she discussed with us (her son & myself) that she wanted to use this money to pay for her funeral arrangements so that when the time came no one would have to worry about it. She then told us that her daughter talked her out of it and that her daughter was going to open a cd account for the money. This amount was about 25k. My mother in law then received the 2nd part of the settlement which was about 19k and we were told that this money went into a cash account.

We asked my sister in law about this money recently and she has told us that there isnt' any more money and we now find out that the money went into accounts in the daughters name. So my question is ... Does my husband have any right to this money? Would it be a waste of time to pursue legal action against his sister? Thank you in advance for your help!

Did Mom have a will? It makes a big difference.

Yes, I would pursue the money. Open up an estate if you have to. You need to talk to a good probate lawyer.
