Legal Question in Wills and Trusts in Texas

Texas Trust

How can I find out what was in my great grandfathers trust -it was in Texas and i am in another state. My father was included but disappeared and has not been located in the past 30 years. The family does not acknowledge that my brother and i exist. Is there a statue of limitations on a trust?

Re: Texas Trust

Trusts are not registered or filed. In fact, a written trust document is not required in Texas. You'll need to do some digging with the older family members to see if you can locate the attorney who prepared the trust if the document can't be found. In the alternative, if a trust can't be located or presented, you will need to go to court to get a declaratory judgment as to the true ownership of the corpus of the trust and the judge will compel production of the trust if it exists.
