texas. Trust held 4 tracts ag land. For forty years they failed to apply for ag value property tax for 1 tract and paid full market rate (10x) creating unecessary expense. can they be sued to recover the expense, lost return and fees

It depends on who "they" are and what the trust says. You should have an attorney look at the trust.
