Legal Question in Wills and Trusts in Texas

No trust set up

My Grandmother left 1/3 interest to her 3 sons, one is a diabled vet, one lives overseas and the other was my father whom gave his interest to the overseas brother, always said he did not give disabled brothers away as he cannot give away what he has no control over. The disabled bother was suppose to have a trust set up according to my Grandmothers will, he recently died and no trust, now the out of country uncle says no trust , no inheritance and he will allow only personal, well there is none due to no trust and lots of high priced real property that he says is all his now? He has collected rents and sold properties over the last 10 years and invested overseas, can we do anything? Thanks
