Legal Question in Wills and Trusts in Texas

widowed homestead remarries

My husband passed 4 years ago w/no will. He has 2 adult children w/1st wife. The house we live in was his, not comm. property. We had a child together after we married. I Homesteaded the house. This year I remarried. New husband/me, children live in the same home.

Qstn: Do I lose my homestead rights since I remarried? If so what are my rights? I just recently completed heirship on the estate in Probate court, giving me ''Life Estate''.

Re: widowed homestead remarries

You retain your life estate in that property unless you willingly and deliberately waive that right. That right remains with you even if you no longer live there.
