Legal Question in Wills and Trusts in Texas

My wife has a 100% no use of her hands.I cannot cash her social security checks,her tax refund checks,or any other checks that are in her name.

if i acquire a durable power of attorney will this solve the problem?

Also,what are the exact requirements for filling out & signing the durable power of attorney form.

Do I have to have an attorney sign this form?

A Durable Power of Attorney should solve this problem for you. Your wife can sign this document in front of a notary using whatever way she signs her normal signature. The notary is there to assure that it is your wife signing the document. No attorney is needed, just a notary. The Durable Power of Attorney should give you specific powers to cash any and all of her checks.
