Legal Question in Wills and Trusts in Texas

No Will - Auto Debt

My father died w/o a will and was buying an auto. He had almost paid off the vehicle and did not have credit life. Can the dealership repossess the vehicle if we continue to make the car payments? How should this be handled? We do not want to lose it. We are under agreement as to who will keep the vehicle.

Re: No Will - Auto Debt

As long as the payments are being made, nobody is interested in repossessing the car. If your credit is good enough, you could likely assume the payment agreement for the balance of the note. If your credit is not so good, you might have to pay a little more to obtain a new agreement in your name. You will probably have to pay some fees to get the payment agreement into your name.
