Legal Question in Wills and Trusts in Texas
No Will Done
My dad is terminally ill and has not
done a will but he said he was leaving
everything to my mother. Is this valid
and if it's not valid what happens to my
father's estate?

Re: No Will Done
Your father's verbal expressions do not constitute a will. A will must be in writing and meet the requirements of the Probate Code. The will may be hand written if entirely, i.e. the whole thing in the hand of the deceased. Your father is making more problems for all concerned by refusing to make a will. But, it's a hard thing to do because it begins -"last will and statement".
