Legal Question in Wills and Trusts in Texas

Will executor

My mother was named the executor of my father's will. She predeceased him. I was never named executor, but I need to be. How can I accomplish this? Do I need to consult with a lawyer here, or is there simply a form I can get and run it through the court system?

Re: Will executor

I am assuming that your father has died, so he cannot revise his will. If he did not name an alternate executor, you will need to file an application to be appointed, and get the other devisees to agree that you should be appointed as an independent executor to serve without bond.

I highly recommend that you engage a lawyer to handle this.
