Legal Question in Wills and Trusts in Texas

No will- minor children

My minor daughter's father died suddenly age 30. He was married with one child. He had 2 other children, one 9 yr. and my 6 yr. old. All different women. Does the wife and her child automatically get everything?

Re: No will- minor children

No. Mother with child will get her portion of community property 1/3 of separate property and his community property + statutory allowance. Other children each will get will get 1/3 of his community and 1/3 of his separate property. Contact an attorney asap to protect your child's interest before wife has a chance to dispose of his/her share. Keep in mind that insurance proceeds, trusts, and retirement benefits will be distributed to designated benificiary.
