Legal Question in Wills and Trusts in Texas

My mother has a will stating, ''All of the rest residue and remainder of the property, real, person and mixed, tangible and intagible, of whatsoever nature and wheresoever situated....I give , devise, and bequeathe unto my three children'' However, she has an annuity that she signed for only the two living children to benifit from; is that okay? She is still living and wants everything done right.

Re: will

An annuity passes by contract without regard to the will. The will only deals with the estate itself.

If she has a question as to how she wants things to go, she should meet with a lawyer that handles probate law. She may be quite satisfied with the way things are already set up.
