Legal Question in Wills and Trusts in Texas
Does every will have to be sent thru probate?
My husband died. We have a 4 year old son. There are 2 other children listed in the will - both over 25 yrs old. My husband specified monies to go to his mother and his children. There is no property that he owned. Do we have to go thru probate for the will that he left?

It depends. Are you or your son named in the will? Do you have access to checking accounts or other source of money for you and you child?
