I think you are talking about a "muniment of title." A simple probate the process for filing a muniment of title (used to transfer title to real estate) is about the same amount of cost and work.

If there are no assets in the estate, there is no need to probate a will.

If you need to transfer title to a piece of real estate, it is better to do a simple probate. In TX it is very cheap and simple. For example, I charge $1,500 plus the filing fee(typically under $200 depending on the county) for a simple probate. It will only take a few months to complete. The important thing is to find a good attorney in the county where the decedent lived who can help you out.
