Legal Question in Wills and Trusts in Texas
Does a will need to be probated?
Friends have told me that they weren't required to probate their father's wills. Do wills need to be probated?

Re: Does a will need to be probated?
Not necessarily; it all depends on the facts of the decedent's estate; size, nature, etc. For example, if there was no property whatsoever, then probating the will would be a waste of time and money. On the other hand, if there's real estate, then probating the will in order to make clear title to the property is far less expensive than trying to get clear title in the future, since there's no link in the real property records between the decedent and the seller.
