Legal Question in Wills and Trusts in Texas

Will & Testaments

My mother passed two months ago in Texas. She had a will and my brother states he is the excecutor of the will. None of my brothers and sisters has seen the will. The excecutor claims mom was broke. He has started selling her personal belongings, without notice and does not return phone calls. I am in a different state. Can I stop him from doing that? What can I do?

Re: Will & Testaments

Contact an attorney in the locale of your mother's residence ASAP! If brother has squandered her assets, he can be held personally liable, however, for you, geography seems to be a problem. In the meantime, contact the probate clerk in the county of your mother's residence to see if probate has been opened. My condolonces on the loss of your mother.
