Legal Question in Wills and Trusts in Texas

Will Trouble

My mother passed away almost 12 years ago. In her will she left me the house, but the title of the house was never changed over to my name. Now my sister is telling me she legally has a right to half since it has been over 10 years. I am scared that she will try and take the house away and I will not be able to leave it to my children Please help me.

Re: Will Trouble

Contact a local lawyer to see if you can do anything. If a will is not probated in 4 years, in my opinion, the property goes to all heirs according to State law...Sad how people avoid probate...to avoid costs..

Re: Will Trouble

Was the will probated? If so, check to see if the estate is still open (most times, they are never closed). Get a new letter issued by the court, and deed the property over. If the will wasn't probated, you MIGHT be able to get it probated as a muniment of title, which would clear title to your name.
