you answered my question on probate however my other question is I dont have the will so I need a copy where do I get one?

You need to find the will. You should check in the county registrar where the deceased lived, check the deceased person's personal papers, look for a safe deposit box and ask the deceased's former attorney, if any. If there is no sign of the will, and there is no copy, then you may have to proceed under assumed intestacy (the deceased could have always revoked by destroying the original).

As a person interested in the estate, you could file for probate of the estate without a will. You would have to serve the other potentially interested persons (the widow, for sure). That might make her produce the will. Gonna cost you some money, but it it's important to you, might be worth it. Good Luck.

Hopefully probate has been opened by the executor and, if so, you can go to the probate clerk's office to view the file. In the alternative, ask the executor to give you a copy.
