Wills and Probate in Texas

My Mother In law passed in February 2008 and her will was written in 1980. She was remarried in 1993. The will was never changed and lists her 1st husband as sole heir,he has passed away and the will lists my wife and her sister as sole heirs if her first husband is gone. The estate is not large but there is an MV Accident insurance settlement pending. Does 2nd husband have any rights to the settlement and does my wife and her sister have any claim on her half of the property from life with 2nd husband ?

Second husband likely has a right to a portion of the MVA settlement. Was probate not opened on the Mother in Law's estate? I would have to review the documents before I can speak with you intelligently about your case. Feel free to call me.

Yes..contact a lawyer before accident benefits are distributed..but you probably need to go to probate Court..we do handle such cases as do many others
