Should all wills be probated? How long a period of time can pass after the person's death can we wait before probating the will? Under what circumstances might we not have to probate a will?

If you have a will of a deceased person, then you should at very least deposit it with the county clerk's office. You have four years from the data of death to probate a will. You can sometimes avoid probating a will if there is no property to distribute and no need to administer the estate.
