does a will need to be probated if everything is left to the spouse. the only thing the deceased had was ckecking, savings accounts and a house.

The will should be probated. At very least, having the will probated will establish title to the house, and the banks will be more likely to cooperate with you in transferring the accounts. If there are no estate debts, then there is a summary proceeding that can be done in probate court called a muniment of title.
