Legal Question in Wills and Trusts in Texas
Three years ago, my father passed away. He had been married to a Chinese lady who passed away before him. Before she died, she put everything into a trust. When my dad died, the house he lived in was meant to go to a chinese niece. However, the lawyer involved has not been able to put the house in her name so she can sell it, as she is not a US citizen (she is here on visitors/student visa).
The house sat empty for a year, then it became a rental. In the meantime, my brother has been paying all the bills. It currently stands empty again.
The question is: Who legally owns the house? Do the three children have any right to the property if the niece cannot get it into her name? What should be done?

I would have to look at the title and trust documents myself before I can give an opinion. A non-US citizen may own property in the country, so I'm unclear as to the hold up.
