Legal Question in Wills and Trusts in Texas
several years a go my brother and i inherited my fathers house, my brother moved his inlaws into the property and since my brother and i don't communicate i don't know if his inlaws are paying rent or not. I want my brother to either buy my half of the house from me or we should be renting out the house and i should be receiving a monthly check for my half of the rent. I don't believe his inlaws are paying rent they (inlaws) i think in exchange for living in the property babysit my brothers children. (this would be their grandchildren). what documents should i send my brother to get him to either buy me out or should i send a notice to the people living in the house that they will now be required to pay rent? HELP!!! This is still an open probate case.

It's much less expensive to have a lease drawn up and just have the inlaws pay you your half of the lease. If the brother is hostile, then you can sue him for keeping the rental payments, and you can ask a court to force the sale of the house (called an action for partition.)
