Legal Question in Workers Comp in Texas
Employee Injury at work
I am not required to carry Workmen's Comp (Texas), so I do not carry it. My employee tripped and fell and hit her eye. It was purely an accident - nothing on the floor to slip on, etc. - just tripped and fell and hit her eye. I took her to the hospital. The eye required surgery. I do not know the amount of the hospitle bill yet. I bought her medications, and emergency room so far and I am waiting for the other bills. My question:: What am I legally responsible for ?

You are not responsible for anything. Accidents happen. However, if the employer was negligent in any way at all, even 1%, the employer would be responsible for 100% of the damages sustained. That is the risk of not carrying comp.
